Legal aspects
The legal assessment distinguishes a number of problems that relate to the law of consent, confidentiality and industry (inter)state liability of harm. These undetermined dimensions and the failure of national and international xenotransplants regulatory authorities to bear their responsibilities for in-depth and strategic responses call for a moratorium on clinical trials and perhaps, in the future, on research in this area as well. There are specific regulations that provide a robust framework for the safe implementation of xenotransplantation and more generally applicable ones such as the Declaration of Helsinki. Xenotransplantation should be evaluated as far as the legal regulation of transplantation is concerned. In particular, the articles included in this section consider patients rights in accordance with existing laws on organ and tissue transplantation, animal research and clinical trials.
